<p>‘소액결제 현금화 산업은 불법이다. 정보통신망법은 ‘통신과금서비스사용자로 하여금 통신과금서비스에 의하여 재화등을 구매·사용하도록 한 후 사용자가 구매·사용한 재화등을 할인해 매입하는 행위에 ‘3년 이하의 징역 또는 3천만원 이하의 벌금에 처되도록 규정하고 있습니다.</p>

<p>스마트스토어에서 핸드폰 소액결제로 주문한 제품에 대한 환불 방식이 오픈마켓과 소셜커머스 등 유통채널에 준순해 차이가 있는 것으로 보여졌다. 오픈마켓은 '포인트'로 환불 해주는 반면 소셜커머스와 대형 온,오프라인몰은 계좌로 '현금' 지급하고 있을 것입니다.</p>

<p>작년 금감원은 소액결제 현금화 등 불법금융선전을 방송통신심의위원회에 신청해 사이트 폐쇄와 게시글 삭제, 계정 중지 등을 확정했지만 ‘언론 보도에는 대응하지 않았다. 금감원 관계자는 “언론의 보도는 선전으로 규정할 수는 없어 보여서 판단하기 힘든 면이 있다”고 했었다.</p>
